Terms of Service

1. Eligibility and Accounts

The Service is provided by the Nixa LIVE Student Production Crew program for students, guardians, advisors, and district personnel affiliated with Nixa Public Schools. To use the Service you must:

• Be an actively enrolled student participant, authorized guardian, or staff member.
• Sign in with a district-approved Google Workspace account or other credentials we issue.
• Provide accurate profile information and keep contact details up to date.
• Notify us promptly if you suspect unauthorized use of your account.

Guardians using the Service on behalf of a student represent that they have lawful authority to do so under district policies and applicable privacy laws.

2. Program Responsibilities

Advisors and program leaders may publish call sheets, schedules, announcements, and educational resources through the Service. Students are responsible for reviewing these materials and meeting participation expectations, including rehearsal attendance, production call times, and assignment deadlines communicated within the Service.

Failure to follow crew expectations or these Terms may result in restricted access or removal from the program in accordance with school disciplinary procedures.

3. Acceptable Use

You agree to use the Service responsibly and only for official production crew activities. Prohibited activities include, but are not limited to:

• Sharing login credentials or allowing unauthorized individuals to access the Service.
• Uploading unlawful, harassing, discriminatory, or obscene content.
• Interfering with the operation of the Service or attempting to access restricted areas.
• Using the Service for commercial solicitation, advertising, or unrelated fundraising.
• Misrepresenting your identity or affiliation with the production crew or district.

We reserve the right to monitor usage, investigate suspected violations, and cooperate with district administrators or law enforcement when appropriate.

4. Student Content and Intellectual Property

Students may submit schedules, reflections, media assets, and other materials through the Service (“Student Content”). By submitting Student Content, you grant Nixa Public Schools and the production crew a non-exclusive license to use, display, reproduce, and distribute the content solely for educational, archival, and promotional purposes related to the program, subject to district media release policies.

The Service, including text, graphics, logos, and software, is owned by Nixa Public Schools or its licensors and is protected by intellectual property laws. You may not copy, modify, or distribute Service materials except as permitted for educational use within the program.

5. Communications

We may send notifications through email, SMS, push alerts, or in-app messaging to share schedule changes, deadline reminders, or urgent program updates. By using the Service, you consent to receiving these communications. You can opt out of non-essential messages by contacting an advisor, but critical operational notices related to student safety or attendance are mandatory.

6. Data Privacy

Our handling of personal information is described in the Nixa LIVE Privacy Policy. By using the Service, you acknowledge that your information will be collected, used, and shared as outlined in that policy and in accordance with FERPA, COPPA, and district regulations. We implement technical and administrative safeguards to protect account data and expect all users to maintain similar care when accessing the Service from personal devices.

7. Availability and Maintenance

We strive to keep the Service available and reliable, but scheduled maintenance, system updates, or outages may occur. We are not liable for delays, data loss, or scheduling conflicts resulting from downtime, although we will work diligently to restore access and communicate significant disruptions to advisors and students.

8. Third-Party Services

The Service integrates with third-party platforms such as Supabase, Google Workspace, Vercel, and other district-approved tools. Use of those services may be subject to their own terms and privacy policies. We are not responsible for the content or practices of third-party services, but we select vendors that comply with district standards and student privacy obligations.

9. Suspension and Termination

We may suspend or terminate access to the Service at our discretion if you violate these Terms, pose a security risk, or leave the production crew. When access ends, we may retain records as required for educational reporting, safety investigations, or archival documentation consistent with district policy. Students or guardians may request account closure by contacting support@nixa.k12.mo.us.

10. Disclaimers and Limitation of Liability

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, Nixa Public Schools disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Neither the district nor program advisors are liable for indirect, incidental, or consequential damages arising from use of the Service.

Some jurisdictions do not allow certain limitations, so the above may not fully apply. Nothing in these Terms limits rights or remedies provided by Missouri law or district policies governing public education programs.

11. Changes to These Terms

We may update these Terms to reflect new features, legal requirements, or program practices. When updates are material, we will post the revised Terms within the Service and indicate the effective date. Continued use after the effective date constitutes acceptance of the updated Terms.
